Controller and legal framework

The controller of data processing is NORD MOBIL d.o.o. with registered office in Samobor, Bobovica 8/D, OIB: 70588786281 (hereinafter: NORD MOBIL or Managing Director)

The data controller undertakes to protect your personal data. The collection and storage of data is carried out in accordance with the provisions of Regulation EU 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of individuals in connection with the processing of personal data and on the free movement of such data (hereinafter: the Regulation), the Law on the Implementation of the General Regulation on data protection (Official Gazette 42/2018) and other regulations governing the subject area, which are applicable in the Republic of Croatia.

Scope of application

This Policy applies to all processing of personal data carried out by NORD MOBIL as the Controller, unless another policy or another document of the Controller prescribes otherwise for some individual processing. In any case, the basic principles of personal data processing, contact details of the personal data protection officer and other provisions specified in the General Part of this Policy apply without exception to any processing of personal data, regardless of whether such processing is specifically processed in the Special Part of this Policy or not. Special cases of data processing, which represent the bulk of all processing by the Manager, are dealt with in more detail in the Special Part of the Policy.

Data Protection Officer

NORD MOBIL has appointed a Personal Data Protection Officer who can be contacted at any time via the address: zop@nordmobil.hr or by mail to the address NORD MOBIL d.o.o. with headquarters in Samobor, Bobovica 8/d, OIB: 70588786281 - for the Personal Data Protection Officer, for issues related to the protection of personal data and for exercising your rights guaranteed by the Regulation.

All requests that are not related to the protection of personal data, and are delivered to the address of the Data Protection Officer, e.g. job offers of candidates or inquiries related to the online store, will be forwarded directly to the competent departments within NORD MOBIL without a special response to the sender by the Data Protection Officer data protection.

Principles of personal data protection

NORD MOBIL pays particular attention to respecting the principles of data processing as a basic value that must be respected during the entire cycle of personal data processing, from their collection until their destruction or other termination of processing. NORD MOBIL processes data:

• Legal – processing will be possible if it is permitted by law and within the limits permitted by law.
• Fair - respecting the specifics of each relationship, applying all adequate measures to protect personal data and privacy in general, and not preventing the respondent from exercising their rights.
• Transparent – ​​informing respondents about the processing of personal data. From the very collection of data, when respondents are informed about all aspects of data processing until the end of data processing, respondents are provided with simple and quick access to their own data, which includes the possibility of viewing and obtaining a copy in accordance with the provisions of the Regulation. Certain information may be restricted only when required by law or when it is necessary to protect third parties.
• With a limitation of purpose – processing personal data for the purposes for which they were collected and for other purposes if the conditions from the Regulation are met. Data may be processed for matching purposes only taking into account (a) any connection between the purposes of collecting personal data and the purposes of the intended continuation of processing; (b) the context in which the personal data was collected, especially with regard to the relationship between the data subject and the Manager; (c) the nature of personal data, in particular whether special categories of personal data are processed in accordance with Article 9 of the Regulation or personal data related to criminal convictions and criminal offenses in accordance with Article 10 of the Regulation; (d) possible consequences of the intended continuation of processing for the data subjects; and (e) the existence of appropriate protective measures.
• With storage limitation – storing data in a form that enables the identification of the data subject only for as long as is necessary for the purposes for which the personal data is processed, and longer only if permitted by the Regulation.
• By reducing the amount of data - processing data if it is appropriate, relevant and limited to what is necessary. Special care is taken not to collect data for which there is no justified need for processing.
• Taking care of accuracy – taking care of the accuracy and up-to-dateness of the data and deleting inaccurate data as far as possible.
• Taking into account the integrity and confidentiality - providing adequate security of personal data with technical and organizational measures, including protection against unauthorized or illegal processing and against accidental loss, destruction or damage by applying appropriate technical or organizational measures. Relevant measures are applied taking into account the riskiness of each type of data processing.

Legality of personal data processing

In order to comply with the legality of personal data processing, NORD MOBIL processes personal data only if and to the extent that at least one of the following is fulfilled:

• The processing is necessary for the execution of a contract in which the respondent is a party or in order to take actions at the request of the respondent before concluding the contract; this is the most common purpose of data processing of respondents where the backbone is an existing contractual relationship or a contractual relationship that is sought to be achieved.
• Processing is necessary to comply with the legal obligations of the controller. The leader as a legal entity has numerous obligations prescribed by various regulations. This obligation includes the collection and often the delivery of data to government authorities.
• Processing is necessary for the purposes of the legitimate interests of the controller or a third party, except when these interests are stronger than the interests or fundamental rights and freedoms of the data subject that require the protection of personal data, taking into account the reasonable expectations of the data subject based on their relationship with the data controller, especially if the respondent is a child. When applying this legal basis, NORD MOBIL assesses that the processing is appropriate for business needs, that it is as minimally invasive as possible, and that the interests of the data subjects do not override the legitimate interests of NORD MOBIL or third parties. Examples of this type of processing are processing for administrative purposes, the purposes of preserving the security of computer networks, the purposes of direct marketing, and the improvement of our business. In these situations, the respondent always has the right to object to such processing.
• Processing is necessary to protect the key interests of the data subject or other natural persons. The right to the protection of personal data is not an absolute right and NORD MOBIL equates it with other fundamental rights in accordance with the principle of proportionality. NORD MOBIL recognizes the possibility that in some situations it is necessary to process personal data in order to protect the key interests of the data subject or other natural persons.
• Processing is necessary to protect the key interests of the data subject or other natural persons. The right to the protection of personal data is not an absolute right and NORD MOBIL equates it with other fundamental rights in accordance with the principle of proportionality. NORD MOBIL recognizes the possibility that in some situations it is necessary to process personal data in order to protect the key interests of the data subject or other natural persons.
• The respondent has given his consent for the processing of his personal data for one or more special purposes. When processing personal data on the basis of consent, NORD MOBIL takes particular care that these are situations in which there are no formal or informal consequences for giving, refusing to give or withholding consent. When processing is based on consent, the subject can withdraw consent at any time without negative consequences. Withdrawal of consent does not affect the lawfulness of processing based on consent prior to its withdrawal.

In some extraordinary situations, NORD MOBIL can process data that would not be processed in regular situations, for example data collection based on the recommendations of the Croatian Institute of Public Health in case of epidemics, etc.

Types of personal data processed

Special categories of personal data: special categories of personal data are processed only if the conditions from Article 9 of the Regulation are met. For example, NORD MOBIL processes the data of employees that fall into special categories of personal data such as data on religious or philosophical beliefs (for example, when exercising the right to additional non-working days for religious holidays, if the individual has voluntarily disclosed such data for the stated purpose), or data which are related to health (for example, according to special regulations on occupational safety or keeping records on workers or when special health certificates are required for certain jobs, etc.)

Information about criminal convictions and punishable acts: when there is a legal authorization for this, NORD MOBIL also processes personal data related to criminal convictions and punishable acts, such as, for example, certificates of non-punishment for workers.

Personal data that do not fall into the previous two groups: such personal data make up the largest part of the processed data, which are most often identification and contact data such as first and last name, OIB, data that is generated based on movement in the area under video surveillance.

Most of the personal data that NORD MOBIL collects is provided by the respondents themselves, and we ask that you do not provide sensitive information (for example, race or ethnic origin, political opinions, religious or philosophical beliefs, etc.) when it is not necessary. If you do provide sensitive information for any reason, by doing so you are giving your express consent to the collection and use of that information in the ways described in this Policy or in the manner described at the time the information is disclosed.

Delivery of data to third parties

NORD MOBIL shares personal data with third parties only when it is prescribed and/or permitted by law, respecting the principle of an appropriate level of legal protection for the rights and freedoms of the data subject, for example:

• employee data is sent to the competent institutes: the Croatian Institute for Pension Insurance, the Croatian Institute for Health Insurance, the Tax Administration, banks in the context of salary payments, creditors in accordance with enforcement regulations, business entities for the purpose of providing specific services such as health check-up services for employees ( contracted occupational medicine), to institutions that organize legally mandatory education (safety at work) or audit companies when conducting mandatory audits, to notaries public when certifications are requested, to the Financial Agency for the purposes of obtaining business certificates, further for the purposes of awarding and using official cards, official mobile phones devices or for buying fuel, etc.;
• business partners who provide IT services, who store them in their databases or have the possibility of viewing personal data until the end of processing;
• business partners in connection with logistics, transport and delivery services and/or service partners and assemblers;
• service providers and associates from the field of marketing and publicity who act as our executors of personal data processing.

In cases where personal data is processed by NORD MOBIL's partners as processors, NORD MOBIL has concluded contracts with them in accordance with the Regulation in which the handling of personal data is prescribed in detail, therefore they are not authorized to process your personal data without our order and pass them on to third parties. If data is transferred to third countries as part of data processing, NORD MOBIL ensures compliance with high protection standards in order to comply with the highest possible standard of personal data protection, in accordance with the strict requirements of the Regulation.

Data retention time

Respondents' data are processed and stored in accordance with the applicable legal regulations when the obligation to keep them is prescribed (for example: the basis for issuing invoices is kept for 10 years), and in situations where NORD MOBIL is authorized to determine the data retention periods, the data is kept as long as necessary for the purposes for which personal data is processed, taking into account the purpose of processing, the legitimate interests of NORD MOBIL and the interests of the data subject to have the data deleted.

Rights of respondents

Regardless of the basis of data collection, respondents can exercise the following rights free of charge within the limits prescribed by the Regulation:

Right to information: the subject has the right to be informed about the processing and its purposes. NORD MOBIL takes care to provide the subject with all the information necessary to ensure fair and transparent processing, taking into account the processing context.

Right to deletion ("right to be forgotten"): the respondent has the right to request from NORD MOBIL the deletion of personal data relating to him without undue delay in accordance with the conditions of the Regulation. To do this, send your request to us as the Controller in writing, including electronic form of communication. Please note that in the request it is necessary to specify what specifically you want to be deleted, since we can store your data based on different legal bases, for example, the respondent can be our customer and a candidate for employment. You have the right to request the deletion of personal data relating to you if one of the following conditions is met:

• your personal data is no longer necessary in relation to the purpose for which we collected or processed it;
• you have withdrawn the consent on which the processing is based and there is no other legal basis for the processing;
• you have objected to the processing of your personal data and there are no stronger legitimate reasons for the processing;
• personal data were illegally processed;
• personal data must be deleted in order to comply with a legal obligation.

In some cases, it will not be possible to fully fulfil the request for deletion, for example when there is a legal obligation to preserve, when the legitimate interest of the Data Controller is stronger than the interest of the data subject, when there is an interest of the Data Controller to establish, exercise or defend legal claims.

Right to access data: NORD MOBIL will, upon the request of the respondent, provide confirmation as to whether his personal data is being processed and, if such personal data are being processed, access to personal data and the purpose of processing, categories of data, potential recipients to whom personal data will be disclosed and other data in in accordance with the requirements of the Regulation. The respondent has the right to receive a copy of the personal data being processed. Access to personal data can be limited only in cases prescribed by law, i.e. when such a limitation respects the essence of the fundamental rights and freedoms of others.

Right to rectification: the respondent has the right to obtain from NORD MOBIL the correction of inaccurate personal data relating to him without undue delay. Taking into account the purposes of the processing, the respondent has the right to supplement incomplete personal data. To do this, send your request to us as the controller in writing, including electronic form of communication. Please note that in the request it is necessary to specify what is not accurate, complete or up-to-date and in what sense the above should be corrected and submit the necessary documentation in support of your allegations.

Right to data portability: The respondent has the right to receive personal data relating to him in a structured, commonly used and machine-readable format in accordance with the requirements of the Regulation.

Right to object: when NORD MOBIL processes data on the basis of its legitimate interests that are stronger than the interests of the data subject, then the data subject has the right, based on his particular situation, to file an objection to the processing of personal data relating to him at any time.

The right to restriction of processing: the respondent has the possibility to ask NORD MOBIL for the realization of the right to restriction of processing in the event that he disputes the accuracy of personal data, considers that the processing is illegal and objects to the deletion of personal data and instead requests the restriction of their use and the respondent has filed an objection to the processing and expects confirmation whether the legitimate reasons of the Data Controller exceed those of the data subject.

In any case, respondents have the right to:

• submit a complaint to the Personal Data Protection Officer,
• submit a complaint to the supervisory body (Personal Data Protection Agency) if they believe that their data protection rights have been violated.

NORD MOBIL, as the Controller, has the right to protect the interests of the Controller as well as the protection of the respondents, and accordingly has the right to carry out activities to determine the identity of the applicant.

Upon request, NORD MOBIL provides information on the actions taken in relation to exercising the rights of the respondent without undue delay and in any case within one month from the date of receipt of the request. This deadline can be extended by an additional two months if necessary, taking into account the complexity and number of requests. NORD MOBIL informs the respondent of any such extension within one month from the date of receipt of the request, together with the reasons for the postponement.

If the data subject submits a request electronically, NORD MOBIL provides the information electronically if possible, unless the data subject requests otherwise.

As a rule, handling the requests of respondents is free of charge, but if the requests of the respondents are clearly unfounded or excessive, especially due to their frequent repetition, NORD MOBIL has the right to charge a reasonable fee based on administrative costs or refuse to act on the request.

Sources of personal data

NORD MOBIL receives personal data most often from respondents. When providing personal data to NORD MOBIL in any way (purchase of goods, applying for a job, etc.), you guarantee that the information you provided is correct, that you are commercially competent and authorized to dispose of the information provided, and that you fully agree to NORD MOBIL using your data and collected in accordance with the positive regulations and conditions of this Privacy Policy.

In addition, NORD MOBIL receives the personal data of respondents from other natural and legal persons, for example from business partners who forward personal data and contacts of their employees for the purpose of executing contracts. When providing personal data of other persons to NORD MOBIL, you guarantee that the information you have provided is correct, that you are capable of doing business and authorized to dispose of the given information, that the respondents whose personal data you forward to NORD MOBIL agree that NORD MOBIL uses and collects their data in accordance with positive regulations and the terms of this Privacy Policy.

In some cases, NORD MOBIL also collects data from publicly published sources when the publication was made for contact for a specific purpose.

Technical and integrated data protection

NORD MOBIL, as the Data Controller, takes care of the highest organizational and technical data protection standards. Therefore, it implements appropriate technical and organizational measures to enable effective application of data protection principles.

Also, NORD MOBIL implements appropriate technical and organizational measures to ensure that only personal data that is necessary for each specific processing purpose is processed in an integrated manner. NORD MOBIL applies this measure to the amount of personal data collected, the scope of their processing, the storage period and their availability. Access to data is limited and only those employees who need it to perform business activities have it.

Handling of personal data breaches

NORD MOBIL as the Data Controller ensures that in the event of a breach of personal data, without undue delay and, if feasible, no later than 72 hours after becoming aware of the breach, the competent supervisory body reports the breach of personal data, unless it is likely that the breach of personal data will cause a risk to rights and freedoms of individuals.

The report submitted to the supervisory authority contains all information in accordance with the Regulation.

In the event of a breach of personal data that is likely to cause a high risk for the rights and freedoms of individuals, NORD MOBIL as the Data Controller shall notify the subject of the breach of personal data without undue delay. Sometimes, in cases where the Regulation prescribes, notifying the respondent is not mandatory.

EMPLOYMENT CANDIDATES AND WORKERS

This part of the Policy regulates the protection of personal data primarily in processes related to employment and employment. In this sense, the respondents are primarily former and current workers, job seekers, people on internships (students), professional development, students who work on the basis of the so-called student contract, scholarship holders and other persons whose data is processed within the framework of labor law and related relations.

In the framework of data processing carried out in connection with employment, NORD MOBIL processes data for the following purposes: personnel selection, conclusion of employment contracts and related contracts, realization of material and other rights of workers, fulfillment of contracts, education of workers, informing workers about processes important for the performance of tasks , protection of property and persons (video surveillance and records of arrival and departure), data protection and other purposes as necessary.

NORD MOBIL's database of former and current employees and other persons within the framework of employment law and related relations is maintained in a separate application. An appropriate contract has been concluded with the holder of the maintenance and support of the application as the executor of personal data processing.

Personnel selection

As a potential employer, NORD MOBIL collects, processes and stores the data of candidates for employment based on their voluntary application.

NORD MOBIL can obtain data on candidates indirectly, from domestic and foreign employment agencies, in which case these agencies are obliged to inform candidates about the processing of their personal data by NORD MOBIL.

Candidates send their job applications based on published job advertisements or as open job applications.

The data of candidates who send open job applications are kept in the candidate database and are deleted within one year.

Data of candidates who apply for individual job vacancies are stored in the candidate database for two months after the end of the tender, and can be kept for up to 1 year with the specific express consent of the candidate, which the Data Controller may request during the tender.

NORD MOBIL has a legitimate interest in using the obtained e-mail addresses, as well as other provided contact information, for contacting candidates regarding employment. For example, after applying, candidates can receive an automatic response that their application has been received and that candidates whose qualifications and experience match those required for individual positions will be contacted. Also, after applying, candidates can receive a text message to the phone number with the proposed interview date, a text message in which the documentation required for employment is specified, and the like.

The stored data is provided by the candidates themselves, but NORD MOBIL, based on the legitimate interest of securing the best candidates, creates personal data in connection with employment activities, such as the results of job interviews, tests and assessments, and collects personal data from third parties, primarily by checking the data obtained during the recruitment process by contacting relevant third parties (for example: recruitment agencies, education and training providers) or using publicly available sources.

Employment and other comparable relationships

As an employer, NORD MOBIL collects, processes and stores all employee data in the employee database, which is maintained in the IT program and in the employee's physical files. The data that is collected is listed in the Rulebook on the content and method of keeping records on workers published by the ministry responsible for work and the pension system.

The necessary data for establishing an employment relationship are, as a rule: a copy of an identity card, a copy of a current account card or payment instruction from a bank, a copy of a protected account (if the worker has one), OIB, proof of professional training (copy of a certificate or diploma), e- booklet: certificate of pension seniority, (obtain it at the HZMO or through the e-Citizens service), Electronic record of the tax card form, the so-called PK form (obtain it at the Tax Administration or through the e-Citizens service, persons who are employed for the first time do not have an electronic record of the tax card form and must open it at the Tax Administration), birth certificate or identity card of the child if he is under 15 years old.

The necessary data for concluding student contracts are, as a rule: a certificate from the faculty for the current year as proof of student status or a copy of the index for the current year enrolled, a copy of the ID card, a confirmation of the enrollment fee for the Student Center (not the case for all student centers), one photograph or Student ID, OIB.

In addition to this data, NORD MOBIL may store in the worker's file other data collected during the employment process, as well as other data collected during the employment relationship determined by NORD MOBIL regulations (for example: awards, warnings, certificates, etc.).

All employee data is kept in the employee database from the date of establishment of the employment relationship and is kept up-to-date until the termination of the employment relationship, and the same is kept as documentation of permanent value in accordance with the relevant regulations.

In its database, NORD MOBIL also stores the data of other persons in a business relationship comparable to an employment relationship or of persons undergoing internship and professional development, from the start of work and keeps them up-to-date until the end of work, and they are kept in accordance with relevant regulations. A special case is the data of students on internship who may be minors, who are subject to special care and whose data are collected and stored in accordance with special regulations with the approval of the school and parents.

Salary data, pay lists are subject to special storage regulations. In any case, all workers and other persons in a business relationship comparable to an employment relationship or persons undergoing training and professional development have all the rights of respondents.

NORD MOBIL, as the Data Controller, can also use the services of various executors who can process data about workers, and who perform certain types of processing for the Data Controller based on the contract (e.g. accounting services, etc.). In that case, the Manager will determine all the basic elements of such processing with the executor in a separate contract on processing, in accordance with the Regulation.

VIDEO SURVEILLANCE

NORD MOBIL as the Data Controller has a legitimate interest in implementing video surveillance measures to protect property and people. NORD MOBIL marks all places where video surveillance is installed in the prescribed manner.

NORD MOBIL is aware that videos contain personal data of all persons moving within the perimeter of the camera (customers, employees, business partners, etc.) and therefore protects them with special care about the safety of NORD MOBIL.

Videos are automatically deleted after a maximum of 15 days from the day of recording. Exceptionally, videos are kept longer if they are evidence in proceedings before competent state authorities. Excluded videos will be stored with extremely limited access.

In the case of judicial and/or criminal proceedings, NORD MOBIL may use the mentioned videos. Third parties, processors, contractual partners of NORD MOBIL registered and expert in the provision of services for the protection of persons and property may also have an insight into the personal data on the videos, who in no way use the given data independently, but take care of the security of central monitoring and reporting systems. Special regulations governing that area apply to all other details related to video surveillance.

BUSINESS PARTNERS

NORD MOBIL has a database of business partners in which personal data of natural persons is also processed (in the case when a natural person is a business partner, e.g. craftsmen, architects, photographers, etc., or when a natural person represents a legal entity with which we have a business relationship: e.g. directors, delivery people, people who receive orders, etc.).

The purpose of collecting personal data is primarily to execute the contract in order to take actions before concluding the contract and to inform existing and potential business partners about the products and services of NORD MOBIL, i.e. about the needs for the procurement of certain products or services for the purpose of concluding the contract. In addition to the stated purposes, it is possible to process personal data for other specific purposes, but always within the framework prescribed by law or if the processing is necessary to exercise rights and obligations from a business relationship.

The data collected are: first and last name, e-mail, phone number, information about the function within the partner's legal entity, bank account number (IBAN) when the natural person is a business partner, and other data depending on the nature of the business relationship (e.g. citizenship, membership in associations when it is essential for the payment of fees, etc.).

NORD MOBIL collects data from the respondents themselves, business partners who provide their employees' data, as well as publicly published data.

Data kept from respondents who are natural persons in a business relationship are kept in accordance with current legal regulations, and in cases where we are authorized to determine the retention periods ourselves, we keep them until the purpose is fulfilled, i.e. a maximum of 5 years from the end of the business relationship.

Business partners are obliged to inform their employees about the processing of their data by NORD MOBIL in case they forward their data.

RESPONDENTS WHO CONTACT US

You can contact us directly, by calling a phone number, by sending mail, e-mail, via social networks or by filling out the contact form on our website for several reasons, e.g. to report the availability of a product, inquire about a purchased product, in the purpose of complaint or even praise or some other purpose that you specify, in which cases we collect data that you give us, which is most often name, surname and contact (phone number and/or e-mail) and content of correspondence. In the event that you contact us via the contact form on one of our websites, for this purpose we will collect information about your name and surname, e-mail address and some other information that will be indicated.

In these cases, we collect personal data for the purpose of a quick and individualized response, based on your request and our legitimate interest, then for the purpose of monitoring satisfaction with our products and services, which also represents our legitimate interest, and in the event of a complaint under the Consumer Protection Act and for our legal obligations.

PUBLIC ANNOUNCEMENTS

NORD MOBIL publishes information that is of interest to existing as well as potential employees, business partners, and customers through its websites, profiles on social networks, advertisements in newspapers, advertisements in other media. Such publications may contain a limited set of personal data, such as first and last name, functions, etc.

The legal basis for processing is legitimate interest for the purpose of marketing, but also to answer possible inquiries. Sometimes the basis can be the express consent of the respondent.

Publications have a permanent character, but processing will stop if, based on the objection of the respondent, it is determined that such objection is justified or if the respondent has withdrawn consent in situations where consent is applicable and in a manner that can be implemented.

PRODUCT SERVICE

In the event that the customer requests product service, he can contact our service center by phone, during which we collect the customer's information: name, surname, contact information (phone and/or e-mail), address if it is necessary to perform service at the customer's address, and information about the malfunction, all of which we keep for 5 years from the service performed.

In some cases, we also provide your data to delivery partners and service providers with whom we have concluded contracts, for product service at your request.

PRODUCT ASSEMBLY

In the case of product assembly, we ask for the following information: name, surname, assembly address, contact information (telephone and/or e-mail). During assembly, it is possible that the assembled product will be photographed in your space based on our legitimate interest in order to prove the service performed, but also to show it to other potential customers (without specifying your personal data). We keep the data for 5 years from the installation service, while the photos are kept permanently for archiving purposes.

In some cases, we also provide your data to external installers with whom we have concluded contracts, for the purpose of installation at your request.

WEBSITES, COOKIES

From visitors to the NORD MOBIL website www.nordmobil.hr, NORD MOBIL can obtain personal data that is used for the purposes for which it was provided in accordance with the information provided at the time of collection (or an obvious purpose that can be derived from the context of collection). Users have control over the personal data they enter in web forms, with the exception of automatic processing due to cookies on the website as explained below.
